"Unknown" is incorrect. You may NOT have your holster any way you want. Even on your own property, a CCW permit is required if you are going to conceal it on your person. But the answer to LV Shoot's question is yes. CARRYING the bag that contains the firearm is the legal threshold.

Please help me clarify in this scenario -- I am in a wheelchair and have a holster clipped under my chair, it is not covered at all but you can only really see it if you are looking from the side at knee level... basically laying down. the article says it doesn't have to be visible from every angle to be 'open' carry -- but would this be considered 'open'? And do the casinos have any different regulations? I don't have any need to carry going through the casino but I also don't want to have to carry a lockbox with me to store it every time I go through... Any help would be great, I'm passing through next week : ) Thanks Eric

The NRS defines a “Concealed firearm” as a loaded or unloaded handgun which is carried upon a person in such a manner as not to be discernible by ordinary observation.
A firearm not visible from a standing officer's position would likely be considered concealed. Moving the holster to the side of the chair where it is visible would be ideal. Casino security, if they see the handgun, may escort you to and from your room, but reports indicate they are understanding of the need to transport legally from outside the casino to a room.
so if im going into the casino to get a room and stay for a week it is ok to put in my overnight bag to check in and leave in my safe for the week or do i have to put it in my holster in plan sight while checking in? Just wondering how to do this without being asked to leave or disarm? bill mccormick curbhugger55@gmail.com
Apologies for not seeing this earlier. TECHNICALLY, if it's in a bag you are carrying, it's considered a concealed firearm. There have been zero issues of enforcement against obvious travelers in the course of moving their luggage around, though in this case, one would expect the firearm to be unloaded, and that may play into their common sense enforcement. Thing of it being the same issue with firearms in checked baggage at the airport. The cops are not eavesdropping at the ticket counter to see who declares a firearm in their luggage.
If you are pulled over for ex:speeding..can an officer confiscate your firearm for any reason? Even if you're legally able to own one? For example he thinks you look suspicious or something and asks or takes your firearm..
Generally, yes they can for officer safety per case law when detained, but usually the officer will only do so if they have reasonable suspicion that you are more than just a speeder, etc.
The officer is allowed to disarm you for the duration of a legal detainment. He is NOT allowed to confiscate the firearm, which implies he does not return it to you when you are done. Also, only a driver is legally detained during a traffic stop. Passengers are not. They are free to leave the scene, and to remain armed. Always start a recording device to protect yourself. Unfortunately, we still have cops that violate laws and citizens' rights.
Although I'm not from Nevada, this is certainly an excellent breakdown of a confusing law. It helps me understand how some of the laws regarding carry in any situation can be interpreted and what to be more aware of. Hadn't heard about the North Las Vegas cops; must be some interesting stories there!
FYI the registration of handguns in Clark County is no longer valid with that law also. I live in Clark County and a "blue card" is no longer required.

DeleteRiding on motorcycle, can I carry a handgun in a saddlebag or in vest with the clip separately located while driving out of city limits?
ReplyDeleteIn this situation, the handgun may be fully loaded, though obviously you would use a secure holster or something else to protect it.
